Ok, this is on search engines generally.
Search engines have a good habit of trying to circumvent what would seem obvious and natural common law.
One classic example is advertising on their search results; sure they stop adverts if you are a registered trademark holder on that key word. But there are other issues, and these revolve around the way they output search results. Effectively as a registered trademark holder on a distinctive trademark they can still push all sorts of websites ahead of your own marks. The search engines on this matter specifically state that "they are not responsible for others content etc".
However, the search engine is a "collective business undertaking". Whether a specific search has adverts on it or not does not matter, it’s whether the whole search engine acts as a business undertaking. Every item in its search result is an advertisement for the benefit of users who click on adverts anywhere on that "collective undertaking".
Hence, search engines in my opinion are responsible for every single line of every search output as a promotion of its own business undertaking. |
